Terms of Service
The agreement between you and GearDepot when you buy or sell here.
Effective
Agreement
By creating an account or using GearDepot, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the marketplace.
Eligibility
You must be at least 18 and a resident of the United States. GearDepot is a US-only marketplace. One person may hold one account; accounts may not be transferred or sold.
Your account
You are responsible for what happens under your account, for keeping your credentials secure, and for the accuracy of the information you give us. You must verify your email address before you can check out. We may suspend or close an account that violates these terms, that we reasonably believe is being used for fraud, or that puts other members at risk.
Listing gear
Listings are screened automatically — including by automated fraud and policy checks — and publish as soon as they pass. We review listings after they are live when a check flags one, and we may decline, edit, or remove any listing at any time.
When you list, you confirm that:
- You own the item, or you are authorized to sell it.
- The condition, specifications, and included items are described accurately, and the photos are of the actual item.
- The item is legal to sell and is not stolen, counterfeit, or subject to a lien.
- You can ship or hand over the item within the handling time you state.
Materially editing a live listing re-runs these checks and can send it back for review.
Buying and protected checkout
Checkout is protected. Payment is captured and held — it is not released to the seller when you pay. When the item is delivered, a 72-hour inspection window opens. Within that window you either approve the item or open a dispute. If the window passes with neither, the item is considered approved automatically — no questions asked: the order becomes final and the funds are cleared for release to the seller. Letting the window lapse is an approval, not a deferral.
Items sell on a first-paid basis: a listing stays available until an order is actually paid for. Adding an item to your cart or having an accepted offer does not reserve it.
Fees
Browsing, listing, and buying are free. When an item sells, GearDepot charges the seller a transaction fee of 5% of the item subtotal, with a minimum of $5 and a cap of $750. The fee is calculated on the item price only — shipping and insurance are excluded — and is deducted from the payout. Payment processing is handled by Stripe, whose own fees may apply to sellers.
GearDepot may run promotional fee waivers or reductions from time to time (for example, a zero transaction fee on everything an account sells during a limited window starting at account creation, which may be extended through referral rewards, subject to a stated maximum amount of fee-free time). Any active promotion is applied automatically when an item sells; when it ends or does not apply — including when an item sells after the account's fee-free window has passed — the schedule above governs.
Sales tax. Sales tax is calculated at checkout and shown before you pay. We collect and remit it in the jurisdictions where we are registered to do so; where we are not registered, no tax is charged and you may owe use tax directly. Tax is calculated on the item and shipping as applicable and is never part of the seller's payout or of our transaction fee.
Keep transactions on the marketplace
Buyer protection, dispute handling, and payout guarantees only exist for orders that complete here. Do not use GearDepot to arrange a sale that is paid for somewhere else, and do not exchange contact details in order to do so. Messages are screened for this, and attempts to move a deal off-platform can result in restrictions or account closure.
This is not a formality — off-platform payment is how buyers in this category get defrauded, and we cannot help you with a transaction we have no record of.
Prohibited conduct
- Listing items you do not have, do not own, or cannot ship.
- Misrepresenting condition, authenticity, or what is included.
- Fraudulent payments, chargeback abuse, or money laundering.
- Harassment, threats, or abusive messages.
- Scraping, automated data collection, or attempts to break or overload the site.
- Manipulating reviews, offers, or search ranking.
Shipping and delivery
Sellers are responsible for packing items properly and shipping within the stated handling time. Where you buy a label through us, tracking updates drive the order status and start the inspection window on delivery. Freight and local pickup follow the arrangements shown on the listing.
Returns and disputes
If an item arrives damaged, is not as described, or does not arrive, open a dispute within the inspection window. Unpaid seller funds are paused while a dispute is open, and buyer refunds never depend on whether the seller has already been paid. Our staff review the evidence from both sides and decide the outcome, which may include a full or partial refund. Decisions are final as between you and GearDepot.
Seller payouts and recovery
Seller payouts follow the schedule in the Store Policy, which may release some or all of a payout before the buyer's inspection window closes based on the seller's marketplace history, the order value, and shipment or handoff events. Payouts are sent to the seller's connected payout account.
Recovery. If GearDepot refunds a buyer under the Store Policy, this agreement, or applicable payment-network rules after funds for that order were paid out to you, you authorize GearDepot to recover the corresponding amount by reversing the transfer, debiting your connected payout account (including its linked bank account), offsetting future payouts, or charging your payment method on file. Amounts owed remain your debt until recovered, and we may suspend selling privileges while a recovery is outstanding.
Your content
You keep ownership of the photos and text you upload. You grant GearDepot a non-exclusive, worldwide, royalty-free license to host, display, resize, and promote that content in order to operate and market the marketplace. You are responsible for having the rights to everything you upload.
Availability
We work to keep GearDepot available, but we do not guarantee uninterrupted service. We may change, suspend, or discontinue features. The marketplace is provided on an “as is” basis to the fullest extent permitted by law.
We are not a party to your transaction
GearDepot provides the marketplace, the payment hold, and the dispute process. The sale itself is between the buyer and the seller. We screen listings and verify sellers through our payments provider before they are paid, but we do not inspect, take possession of, or warrant any item.
Closing your account
You may close your account at any time from account settings, subject to the record retention described in our Privacy Policy. You must first complete or resolve any open orders, payouts, and disputes.
Changes
We may update these terms. If a change is material we will update the effective date above and notify you. Continuing to use GearDepot after a change means you accept it.
